Many small business owners looking to save money share common misunderstandings, especially those new to business, that independent contractors and employees are interchangeable and all employees can legitimately be classified as salaried. Those assumptions are incorrect.
The watchdogs of the classification of workers include the IRS, the EDD and the Department of Labor. Most recently, the courts and now legislature in California are working on codifying the definition of independent contractor.
